Party Wall Matters

Under The Party Wall Act 1996, If You Or Your Neighbour Intend To Carry Out Work On, Or Close To A Party Wall/Structure/Fence Etc. There Is Legislation In Place That Requires Strict Compliance With The Provisions Of The Party Wall Act (1996). These Involve The Issuing Of Notices To Your Neighbour Ahead Of The Proposed Start Date, So That Your Neighbour Has The Opportunity To Accept Or Object The Proposals. The Party Wall Act (1996) Grants Extensive Legal Rights Which Do Not Necessarily Exist At Common Law. If You Commence Work Without Adhering To The Provisions Of The Act, Potentially Your Neighbour Can Apply To The Court To Have The Work Halted (Through An Injunction), Until All Matters Under The Act Have Been Resolved. Costs Can Then Be Significant. It Is Important Therefore To Appoint A Professional Who Is Familiar With The Provisions And Procedures Of The Act, And Who Can Represent Your Interests As The Building Owner Or Neighbouring Property Owner, In Formally Producing An “Award”,

Which Is Then Legally Binding On Both Parties.
